Of Simple Causes. Corporal Extenuations Injuries
him , after he had cried for mercy; and immediately thereupon
you fell upon the man and beat him: in such case the provocation
is Still to be deemed a recent one.
4. A Series of Provocations become recent by Continuance. In like manner a series of distinct provocations
which are all of them recent with respect to one another,
and of which the last is recent with respect to the injury
in question, are to be deemed all of them recent
with respect to the injury in question.
Prosecutions for the same quarrel may be consolidated. In a prosecution for a simple personal injury either
party may make proof of any thing that happened during
the course of the same quarrel (A A); and the Court may
order both or neither to make compensation to the other,
as also on either or neither or both inflict a pecuniary
or other penalty; and it may order either to pay the
whole or any part of the other's costs.
One Quarrel, what : [(A A) Quarrel] A series of provocations all of them recent with respect to one another and with respect to a
personal injury which concludes them, constitute what
may be termed one quarrel.
