From p. 13. Why Fine is made one of the articles in
the punishment?

Reasons
Because this alone of all the various possible
modes of punishment is capable of being converted
immediately into a benefit by in virtue of the application
that may be made of the money which
is the produce of the fine. Money levied in the
way of a fine produces a double benefit: in
the way of punishment by it's effect upon the
offender: and in the way of a tax by standing
instead of so much money which otherwise must
have been be levied upon the innocent.

Why Imprisonment is made one of the articles
in the punishment

Reasons
1. To provide against the case of the offender's
not having wherewithal to pay a fine.

2. To provide against the offender's being secretly
supported by a confederacy; who if the punishment
were merely pecuniary might save
him harmless. See Ch. Of Punishment.
