From p.2. Why an additional a further punishment is appointed
in addition to that which is necessarily included
in the obligation to make amends?
Reasons
1. Because without such addition there would be no making
sure that in all cases the value of the punishment should outweigh that of the profit of the offence.
1 A notion would would be put to prevail among the
rich, that for a certain sum they might at
any time be at liberty to satiate their any displeasure
they may conceive against the poor. There is no being
certain in any case, before hand, that the sum
which the Judge may allow a man in the
sum of compensation will eventually prove
sufficient to answer that design. Should it
ever fail of this to do so it will so often
leave the party injured a loser, and probably
the offender a gainer (in pursuit of satisfaction,
by the upon the upshot of the whole affair.It is not always
that what is enough for the one to receive
is enough for the other to pay.
