14 C Of Simple Personal Injuries
Question
Why provocation is made a Ground of Extenuation?
Reasons.
1. Because this circumstance detracts from the
mischief of the offence: See Tit. [Proportion &c]: Rule viz
from the secondary mischief. When provoked
to a certain degree you may be driven to do
mischief: in that case you may be dangerous.
But in that case only. So long as a Man behaves
to you as he ought to do, he has nothing to fear
from you.
2. Because this circumstance detracts from the
depravity of disposition as considerd evidenced by the Act.
See Tit. Proportion &c Rule ---
Question
Why even an imaginary provocation is made
a ground of extenuation?
Reasons.
1. Because the same reasons apply to an
imaginary one, if sincerely imagined, as to a real
one. The only reason why the force of the extenuation
should be less in the former case than in the
latter, is the difficulty of ascertaining the
matter of fact with respect to the sincerity.
