Simple Mental Injuries.

I

A Simple. Mental Injury defined. A simple mental injury is either positive
or negative: A Simple positive Mental Injury is it is positive where without lawful
cause (A) a man is concerned (B) in occasioning (C) pain or uneasiness
of mind (D) to another without committing any other offence: on
A it is negative simple mental injury is where
knowing a man him to be in immediate danger of sustaining some pain or uneasiness
of mind and being bound to use (E) your endeavours to save him from it; you forbears to do so,
for want of which endeavours such uneasiness is undergone by
him.

[(D) Mind] For instance if a man were to exhibit a monstrous
or horribly-distempered object to a person of a delicate constitution,
such as a pregnant Woman: or tell her a shocking story; or
tell her in an abrupt manner of the death of her husband or
of any person particularly dear to her: or were to uncover his
nakedness, or use obscene language or gestures before a modest woman:
or by a false tale were to terrify her with the apprehension
of a mad dog, or a housebreaker, or an
earthquake: or of a ghost or vampire or other such imaginary being.

II Punishment, Aggravations and Excuses Extenuations

Are the same as for Simp. Pers. Injuries: but such the aggravations,
are are without the extra-punishments.
