10 C> Of Irreparable Personal Injuries.
Doing a Greater Injury when intending a less.
10. If the offender intending to do an irreparable personal
injury of one sort is eventually instrumental
in doing an irreparable personal Injury of a worse
sort; he may be punished only as if he had done that which
he intended; but he shall make compensation as for
that which he has done.
Doing a less when intending a greater.
11. If intending a greater injury he do only a less, he
may be punished as for either.
The Stigma to have the preference over Retaliation.
[Stigmatised] If the offence consist in irreparably
disfiguring a person in the face in such sort that if the
offender were to be disfigured in the same manner there
would not be sufficient room left to apply the stigma, the
stigma shall be applied in preference.
In other cases, the punishment may be more in degree
but shall be no other aggravations in kind than for a simple
personal Injury.
