C 15. Offences Of Falshoods in general
cases of delinquency. If therefore Now if at any
given ti moment there be a case fact which a man
can not be called upon to make oath to, and therefore
an effect which a man can not produce
by Perjury, at the next moment it may be otherwise:
for the next moment the legislator may render
an oath administrable likewise in that care. The
other answer is that the objection is not true in fact.
For under my system of legislation however imperfect
in which Oaths are nt all employ'd there seems not any fact which a man may
not by possibility have occasion to make oath to: if
not on its' own account, yet at any in an evidentiary
character in virtue of its connection with
some other. For every fact that is real is in truth
committed with every other: either If not as influencing or at least as indicating
its existence: if not in the way of collateral
relationship if not of lineal. If there be a mischief
which let the facts made to be what they will
a man can not bring upon another by Perjury by
influencing the censure of the law: because the
law inflicts no such censure in any case; he may
at any rate by influencing the unlicensed conduct of
some person at large. For whatever mischief may be
inflicted
