Real Property§. 5. Proper Object or End

Now then so it is, which of these two descriptions
of persons compared with one another the interests are in a state of direction opposition
the one to the other: in so much that whatsoever
is desirable to the one is the reverse not desirable but the
reverse of desirable to the other.

First then as to the objects or say ends in view
which are not with reference to these same "methods and
"forms", or say operations and written written instruments.

In my view of the matter, these may be in
brief be thus enumerated.

1. All comprehensive and Main end
Giving execution and effect to all such proposed
obligatory transactions. Consequences and engagements included
in relation to which the Law meaning the
ruling powers or say constituting authorities shall have
thought fit been desirous to give binding force,
in other words desirous that such binding force should
be given.

2. Collateral ends Subordinate end or ends, exclusion of all doubt
thence of uncertainty in relation to these topics or say questions in the
determination eventually place by the one in relation to
which by the competent authorities that is to say the
Judges it will depend whether execution and effect shall will eventually
be given to the respective instruments.

These topics or say questions are the the subject matters
are

1. The intended import of the instrument in question – which is throughout.

2. Its intended import being ascertained is the disposition arrangement made by the
instrument of the number of those to which it is the intention
of the constituted authorities that binding force should be given.

3. Its intended import being ascertained, that is to say the
import intended by the draughtsman was it the intent of the
several parties persons named as parties to give their
respective consent should be considered as thereto given.
