Under English law The the consequence and the professional assistant in causes
many and the professional assistant in litig litiscontestation
being one and the same person the professional individual in
his conveyancing capacity can never want the maker
and to an inconsiderable extent possesses the money
and opportunity to make business for himself in his
other capacity. In so far as his reputation appears
to him to be in danger of suffering from the taking
advantage of this opportunity he will have to choose
between the danger to his reputation, and thus the ultimate loss
to his person on the one hand and the profit to his purse
on the other. But to no inconsiderable extent no
such danger will present itself: and the danger magnitude
of it is the less less and less in proportion as the legal
both in regard to conveyance and in regard to litiscontestation
the state of the law legal rule of action is adverse to those
which are its ought to be its real ends and actually
are its professed ends.
Under Rome-bred law in general, and thence
all over under the Christianized parts of the European Continent the
Conveyancing professional assistant in the conveyancing business and the
professional assistant in the litiscontestational business are
in no instance one and the same person.
One consequence is that of all professional men the
Notary such is the Conveyancing assistant's denomination is
the object of the highest esteem and confidence.
