To obtain a gross conception of the probable number into
which they might stand distributed after [being reduced] consolidation
in the mean time until the matter can be more accurately minutely
investigated, + let us cast an eye over the Titles in D.r Burn's
Justice.

The limits of that Book (as the magistrates whose Office is
there delineated have cognizance in some step shape or other of
most articles of Political Oeconemy) coincide nearly with
those which in our first attempt we propose to prescribe to
ourselves.

These as may be seen in the margin amount in number
to . . . . & consequently the Number of Statutes into
which the collection would be cast would if that plan were
to be adopted without variation for this purpose be the same
But this, according to the principalse of aggregation which
it is here proposed should be adopted, will in some plans

require or admitt of further division ++ in others of further
union, in a few perhaps of total omission. Those to wit —
which are inserted for the sake of Historical ornament rather than
containing regulations now in force.


++ N: For example, I should not arrange dispose the regulations —
concerning Pawnbrokers under the title Cheat; tho' the —
regulation in both those subjects happen to be comprized
under one Statute. The idea-annexed to the word Cheat is
rather undeterminate: but taken in it's most extended sense
it is a genus comprehending several different species of Offences
belonging to the criminal code.

The defalcations that will be made from each are another
consideration in another place: for example under Title Clergy
nothing will be to be said of the benefit of Clergy extended to
persons at large.

This number immense as it is, is far enough however from including
all which come within this part of our plan design,
D.r Burn Under the single title of Coals speaks of no fewer
than 40 concerning regulations the weight measures and prices of that
commodity, which on account of their locality, tho' the greatest
number of them concern the Metropolis , he has omitted. So under Title Pavers relating to London, 5, & other particular placs 4. So under Thames 12. So under Woollen — Manufacture 23.


Under Title Marriage are is composed of two Paragraphs: both taken from
one Statute 26. G. 2 .33.

The first, prohibiting clandestine solemnization belongs to the Particular
Code relating to the Clergy, as far as it concerns persons of
that profession, & to the Title Personation in the General
Criminal Code, as far as it concerns persons at large.

The Second prohibiting Forgery of Marriage Registers,
belongs also to the Criminal Code: and comes under the Title of that —
crime.
