not being understood to be any part of the design of those who
introduced the Law to abolish it [I mean the Custom]
and the words of the Law not being precisely levelled at it.
The Magistrates whose custom it had been, were naturally
disposed to give such construction to continue it, and in that view to give the
Law such a construction to the Law, as had it not
been for the Custom, they probably would probably not have been
that which they would have first pitched upon.

In the next place, the description identification of the Magistrates
who are to appoint the time and place of the meeting
of these tribunals is much too lax. "Two or more",
(that is any two or more "of the Justices acting for the
"Division" [26.G.2.r.31/4] are to make the appointment. But what
may very well happen is that one set of "two or
"more" may join in appointing one time or place
of meeting; and another set of "two or more" may join
in appointing another: for Justices like other men may
have their disagreements. In this case what is the Two contradictory warrants then
High Constable to do one from each set are issued to
the High-Constable. In this case what is he to do?
Obey that the warrant Which warrant is he to obey? that which happens to come to him
first, or that which is signed by the greatest number,
or that which it best suits him to obey? Suppose the numbers
equal, and that the warrants come to him nearly at
the same time; the difficulty is encreased still further. And
