The fulfilment or the disfulfilment of the ends of justice The fate of suitors, the prosperity of families, by hundreds
and by thousands, turns upon these words: since precise
import must, if possible, be found for them.
The effect of the Appeal upon the feelings of the parties,
is that what is meant to be expressed by the word
vexatious? The in demand and quantity of delay
and expence being given the same one Appeal is as vexatious as
another: or if there be a difference it the more vexatious of the two is the Appeal of him
who is unable being in the right as adjudged to be so, and
who thus gains the cause which his adversary loses it, is still more
vexatious than the appeal of him who being in the wrong
loses the cause.
If this be the sense proper to be put upon the word
vexatious, it will only be by accident of the appeal of
him who is in the right will when compared with the
appeal of him who is in the wrong, whether conscious
or not conscious of his being so, be more in a superior
degree vexatious.
