In general, the practical use of the distinction is this:
viz. that where temerity or the only extent blame imputed
there the compensation satisfaction to the party injured may serve
to mark out and limit the quantum of the burthen proper to be
imposed: here being a burthen that must be borne by
somebody, better lay it upon that one of the parties in
whose conduct the apprehension of it may exert stands a chance of exerting a salutary
influence, than on that other of them in whose conduct
the apprehension of it could exert have no other than the considerable
effect of causing him to submitt to rejection,
and abandon his just due.

But when the blame rises to the height of the
mala fides punish affliction over and above what is
inseparably attached to the burthen of satisfaction may be
made applicable to good use. If he offends transgresses he offends
on calculation: can therefore should be taken that he
may never after a in no case, upon one account of profit and loss
find himself, or be previously assured of finding himself, after satisfaction rendered and punishment
sustained, a gainer upon the ballance.
