Scotch Reform

What then, my Lord, is the result – the practical result?
that they should never be heard? it would be a the determination would be
as far from justice and procedure, as that parties or Counsel
should never not be heard. Yes my Lord: being parties they should
be heard: and but with the same view and in the same frame of
mind that parties in other cases are heard: being Counsel Advocates
Counsel standing Counsel for abuse in every profit yielding
shape which is as much as to say in every shape – they should
be heard – but with the same expectations, and the same frame
of mind that counsel for smugglers, swindlers, smugglers
peculators are heard.

Yes my Lord in one point of view – in every of
view if rightly employed applied and learned to use, their assistance is as valuable as
it is indispensable. In proportion as any arrangement
is efficient in the nature and premises, shall I say, or thereabout to be helpful subservient serve as an
constitute form a useful feature in
to the plan interests of reform, every objection inconvenience that experience practice
has brought forth, that analogy can indicate, or imagination
hatch paint to itself will be sure to be brought to view, and in its
strongest colours. This surely is no slight weak security: this
surely is no unimportant use light advantage.

Another use – though in its nature a much more
spirited one, is that which in the way of confession or its equivalent silence may
now and here and there be expected from their candour, much more naturally
and frequently from their distress, confusion and despair:
Their situation will be is in this respect exactly that of a Defendant in
the Court of Chancery or at Bow Street, Of what
he thinks fit to say, so much as realise for him, may be
true or false: as much as makes against him
is true or he would not have said it.
