The remedy, this simple, safe and efficacious salutary remedy
the excellence of which is attached everywhere and by every day's
experience, is has been confined hitherto, and with no small anxiety
to causes of a certain description and beneath a certain
value. Confined with no small degree of anxiety: of that anxiety and the
reason the cause of it is obvious. In the Small Debt Courts there is
nothing to be got by lawyers men of law.
But with equal safety, as well as equal efficacy,
this same remedy might be extended and applied to causes
of all descriptions without exception: extended over the whole
field of the law. To enable it so to do, it requires indeed a
few obvious modifications: of these modifications I to carry a general
conception has been partly the business among the labours operations of that work.
This remedy, can while with the main body of the law in
its present state would do much: but with the main body
of the law in its present state it would not do everything.
And this it is that brings us to speak of the state in which
the deplorably and neglected state – the state of obscurity and uncertainty
the state of unwritten law as it is called in which the main body of the law has hitherto been, and still
lies: and it is to the translation of it from this state into
a better, the state of written law – the only state in which it which is not
as befitting of reproach and disgrace as well as continual suffering to a civilized country that the labour the fruit of
which forms the subject of my the present offer would be directed.
