The So far as concerns the giving to the suitor the
plaintiff the advantage of choosing the best-filled best of the
two or the tree Courts, whatever such they may be, the benefit
of competition is what I am not disposed either to deny
or to undervalue.
Bu taking experience for my guide – I mean experience
in the individual field of in question – of its the
force and virtue in the production of good judicature, taking
this principle by itself my expectations, I must must acknowledge,
are not extremely sanguine: in particular as
to its doing more towards the prevention of factitious delay,
vexation and expence than may be expected to be done
by the force of money in the shape of fees, towards the
increase of that mass of collateral inconvenience.
The learned and goodly fellowship among whom it is proposed
to plant sow the seeds of emulation by dividing them into three
groupes are the same learned body the members of which
though acting all together in a room called the Inner
House, are in the habit of acting every day, each by himself,
in a room of one of an assemblage of rooms at no
great distance from the Inner House, and forming all of them
together what to some purposes is considered as one House,
and called the Outer House. Here then instead of a competition
confined to those Chambers is a competition extending
the President not being included in it, extending to as many as
its Chambers.
