Scotch Reform To Ld Grenville

Under the technical system that is under the as yet predominant
part of every existing system, fabrication production of
undue delay (let it never be out of mind) not prevention of it
has been among the objects the ends really pursued and aimed
at. No wonder that for the prevention of delay this mischief, this crying grievance no
system of arrangements, directed bonâ fide with security and with a degree
of skill and intelligence correspondent to the progress made
by the human mind in other arts, should as yet
be anywhere to be found.

The greater the difficulty attached to the making
of such fixations – and thence the greater the difficulty
of applying to this purpose the force of the political or
legal sanction, the greater the necessity for endea having recourse
to the moral or popular sanction, and endeavouring to
apply it to the best advantage: viz. by causing
the quantity of extra delay produced generated in each individual
instance to be matter of general notoriety together with
the circumstances, if any, by which a proper demand
for it, a justification of the line of conduct maintained by the
Judge in the production of it, was in each such instance
constituted.
