Scotch Reform To Ld Grenville

The existence of the circumstances being declared by the
Judge to and in the presence of both parties, let both of them
be called upon at the same time to respectively express to either
assent or dissent to the existence of the circumstance, by
their respective signatures, in terms expressive of a stronger knowledge
or belief or less strong degree of persuasion – knowledge or belief, according to the nature of the case. The existence
of the circumstance the declared cause of delay, being
in most instances (as can be may be seen in the Table) matter of notoriety, and the parties
in this as on every other occasion, the parties speaking
and writing under the obligation of an oath, or what is
its equivalent, neither refusal or falshood nor dispute
will be an incident inconvenience generally to be apprehended.

In this or that instance should it happen that
the existence of the circumstance to the degree in question
is matter of dispute, the propriety of the delay in itself
(the quantum of delay granted or refused by the Judge) will
depend upon the existence of that matter of fact: the propriety
of the decision thereupon pronounced by the Judge, will
depend upon the propriety of the opinion, declara whereby he
affirms or disaffirms (regard being had to the quantity in
question) the existence of that circumstance: distance
of the abode of the proposed witness from the Court, so much:
time requisite for the journey &c so much.

The circumstances being in general of a nature equally open within
the observation of the most ordinary and dullest eye
to the meanest capacity – for instance, number of persons present
in the character of plaintiffs: defendants witnesses and so forth, the
framing of the conception to be expressed as above, by the respective attestations of the parties, consistent
with propriety be stated as matter if insuperable, if of any difficulty.
