The object of the provis Upon the face of the provision, the
object of it is to prevent delay – factitious delay. But
what if the effect an interlocutor be pronounced, the effect
and mischief of which – whatever have been the object – is to produce
delay? Here then we have a remedy consisting in
the denial of all .
Will it be said that the delay which in the House of Lords takes place of course,
by necessity and without any thing like blame on the part of any body
is so great enormous, that no delay equal to it could be reasonably
to be apprehended from any interlocutor of the supreme Court
at Edinburgh.
This indeed I fear In this From the facts which have been made
public, I fear there may be too great a probability near an approach of truth.
But on this subject the subject is too important to be treated discussed
of in a parenthesis: it is one in which I have it in
contemplation to submitt my thoughts to Your Lordship in
a separate address.
What appears at any rate, is – that here is a source
of delay, to which, so far as this provision is concerned depends on this provision
the plan affords no remedy neither affords, nor indeed can
will be said, so much as to profess to afford a remedy: and
whether any in the remaining parts provisions of the plan there be
anything of which the deficiency can be is in a way
to be supplied is a question that will presently be submitted
to Your Lordship in its place.
