The view I given of the nature and cause of undue
Appeals, I have already stated as being erroneous: the
error designed or undesigned is not without its use
I mean to those by whom it is who propagate it currency is thus given to
it.
The notion conveyed as by the terms of the Resolution
insinuated at least, is – that undue Appeals Appeals where undue are
mostly if not altogether, the result of passion: the product
of temerity, not of mala fides. Passion such taking takes for its
object the gratification of enmity ill will: the pleasure of heaping
vexation upon the adversary. In the morbid state of disturbance
into which the intellectual faculty eye of the mind is thrown by this passion,
frivolous grounds present themselves as substantial ones.
Frivolous the appeal is rendered by the unsolidity of the grounds
it relies on: vexatious from the motive which gave gives birth
to it.
That in some instances such is the psychological genealogy
of undue Appeals, I see no reason to dispute: but
that undue Appeals thus generated constitute the bar most formidable
or largest part of the grievance, has will I flatter myself been be
put out of doubt rendered sufficiently apparent.
