26 Jany 1807
To Ld Grenville

Yes, my Lord, under this most perfect of all perfect
systems there are two species or degrees of improbity –
one which a Judge will always lend himself to – and without
scruple or disgrace – because his colleagues do along with
him as his predecessors have done before him – and which
consequently professi with other lawyers, professional as well
as official will also lend themselves to – at least without
exception or reason. These are the species
of improbity which being legalized are safe.

There is another species or degree of improbity
which neither Judge nor other lawyer with being a
man of character, and not in or
circumstances will lend himself to – this or that which
not being legalized is not safe.

In the French Revolution two degrees of
stood were distinguished by appropriate names: revolutionary –
simply revolutionary in the one; ultrà-revolutionary, the
other.

Transfer the distinction with its nomenclature to here, the distinction may
be not without its use: in the term of injustice, express
only mean the word? corruption – of enormity two
degrees: legalized (or shall we say judicial?)
the safe: ultrà-legal, or ultrà judicial, the unsafe.
