Sanction given and properly given, by authority to the the labour of one individual, has not unfrequently
been furnished given occasion though improperly to a pretence for a prohibition put
upon the rival labour of other individuals at large. Here
no such abuse took place.
Thus far everything was well. Here were the antient
English Year-books. Here were the more modern Year Books,
projected, but if carried into execution, never to any
useful purpose, in the feeble reign of James the first.
When the authoritative publication of those Scottish Year
Books saw came to see the light, one observation was made the fact came out, that of the
best least bad materials of sham law there was nothing to be found,
Judges all a folio of reasonable bulk, and the contents but filled of
it from beginning to end, composed of nothing but of that
second least bad sort, I have already been describing to
Your Lordship, so compleatly unfit for use. Judges, had
the original scene borne any resemblance to the picture here
given of them, Judges, the Stock-fish: at the Bar among the Advocates
no want of words, but as to the words or the adopted in tenor
or in effect by them while Lordships, all or any of them.
This, as if it had been a point of no importance, was given up abandoned
to conjecture.
