Scotch Reform To Ld Grenville

In the view account thus given of the receipt of the Exchequer
of Representations, I have already, though as yet but by
a side-word denounced this whole system of Outer Houses as
neither more nor less than so many outworks of the fortress Castle Blackstone Castle
of chicane, so many bars and pitfalls man traps set down on the road to
justice. Between these and the representations the connection is
not
between the factory and the work done in it, the connection
is not a loose one. What are Outer Houses good for? –
to receive representations in: – what are representations good for?
– to be received, along with the shillings in Outer Houses.

These Outer Houses are among the edifices which the learned
Improver, in partitioning off the Court of Session into Chambers
has been so careful to have untouched. Why and Wherefore?
why because causes, as we learn from Resolution the 4th are by
nature two-fold, viz: Inner House causes, and outer-house
causes: whereupon if there were no Outer-Houses, there could
Outer House causes would not be tried at all: inconvenient.
Just as when a man has existed on the other side of the Tweed, there be
Common Law causes, and there be also moreover Equity Causes: whereby
the necessity of having a Court for each species of cause, and
if there be but one Judge or set of Judges for both Courts, fitting
up a strong partition in the pericranium of each to prevent
Law and Equity causes from running into one into another, and being confounded, is evident becomes apparent,
and incontestible.
