Scotch Reform To Ld Grenville

On this occasion, an implement of no mean use to the
legislator would might be a Table comparative Table of the names in use
of civil actions or demands in use in the several systems of procedure
with which we as Britons have most occasion to be
acquainted. The number of columns in it would be four:
one containing a set of natural denominations, as expressive
as, whether by selection or invention as they could be made, to serve as a common medium of
explanation and standard of reference: another the second containing the
technical denominations in use in English law jurisprudence, the third those
in the Roman, the fourth those in the Scotch.

In so far as these demands can be made to wear a penal form, being demands
for satisfaction on the score of some wrong and thence
of some transgression, already committed, the a list of natural
denominations, or at least an attempt to make one is already
extant and
to be found in one or both other of two works already extant. Introd. Dum.

So far as they are incapable of wearing a penal form
as above described, they would remain yet to be composed.
But the object of demand being in every case some sort of
service, the list of such demands would correspond with the list
of services. Nor would the principle of division and arrangement
be here to seek: for as in the Tables lists above alluded to, Offences
operating to the prejudice of individuals are distinguished according
to the different respects in which man is susceptible
of injury – Offences striking against person, against reputation, against
property, against condition in life, against person and reputation,
against person and property together, so in a way equally natural
may services acts operating to man's advantage.
