9. Section the 17th has takes for its subject the order of forms to
be observed on the occasion of no concurrence of the division in the
filling upon vacancies in the judicial suits
on the occasions in which a vacancy comes to be filled
up in any of the judicial suits. The forms to be given
of admission to be given through division which to
the Judge is appointed to has in case of an objection
to any such admission, the object of

Let me not here be misconceived misunderstood. In the comparison reference
which for illustration sake I may have occasion to make
to the technical branch of English procedure, I have no such meaning as to
propose it as a model for the procedure adjective branch
of Scotch law any more than of any other body of law.
A beacon to steer clear of such is the character in which
it will be found most more useful in upon the whole much
more useful than in that of a model to build from.
But as it is upon the whole, yet in this or that such or such a
point as they occurr, it is not yet so bad as the Scottish
System is in relation to those same points. is These
abuses abusive arrangements do yet exist, even in a system so replete with
abuses as the English: therefore they are not necessary anywhere in
any, and in particular not in Scotland the Scottish. Such
is the use to be made of a bad system, where the object is
by chance or some other principle of action to engage men to
set their hands to the reformation of and still worse.
