The moment As therefore, and as often as a man
finds th in the cause anything that draws upon his fee
that which he has not in the treasury of his mind to honour it with,
he sends it out of his hands.
A case reported by a Reporter of the English School the learned Mr Joseph Metier
exhibits at one view the condition a cause may find itself
in in that Scottish Court judicatory and the sort of Judges task
which it may without any such degree of inconvenience
as which be decreed sensible, be filled.
It is the case of the Old woman, the young man, and
the show of brawn. Disqualified as she was by want of a deficiency in the masticatory
organs from disposing of it by digestion, she suffered it
to drop it made its escape out of her mouth, onto the plate
of her more neighbour, who, heedless of what
had happened to its , took it up and swallowed it.
The mouthful of brawn is the cause – the receptacle infirm Lord
Ordinary without palate is the Old woman without – the
whatsoever Lords perform the office of the function performed by the Young
shot after the brawn had been to no purpose
fell to swallow it, is the office function performed in the Inner
House by the whole Lords.
From his station in the single seated judicatory he passes it is
true in his turn regular course and relation into the Inner House, there looking for superior judicatory
of the Inner House. But in that superior judicatory of the two judicatories a still superior
facility is afforded of performing duty without any expence of the article of thought thought.
