Under a proper system of pleading, grounded moulded on a properly
framed system body of substantive law, this the plaintiff will in every
case do be enabled to do without difficulty.
For the correspondent portion of the body of substantive
law cannot have been properly framed, but all those
several grounds of demand and grounds of defence must
have been particularized. Ha In the case in question
here are, for the species any service of the sort of those
which I am now deriving at the hands of the Judge,
the sorts of facts any one of which supposing it to exist
would be sufficient to give me a good title to that service: provided
always that if twenty other sorts of facts of which
any one supposing it to exist could be suffered to destroy
the title so constituted as above, as no does exist case be shown to have
existence. But in asserting that the a fact of a native he particular individual fact in question, being
of one of those sorts of
facts any one of
which is provisionally sufficient be
to constitute a title in any favour, I assert at the same
time the non-existence of all such individual facts as if
they existed would come under any of those twenty sorts
of facts any one of which could be sufficient to destroy
such my title.
