Though in the character of a code of procedure, say
as that of an adjective code it were to be compleat – as compleat
as it was is in the nature of an adjective code
framed by itself, and without any appti adjustment
made of it to the corresponding substantive code it
were capable of being, as I have just been intimating still it would be but a mutilated
judgement, incapable of answering to any considerable
degree of perfection its professedly intended purpose.
Why? For this very reason, because there exists
no substantive code on which it can stand, and to which
that is to the tenor, to the words of which the words of it
can be adapted and applied. To bespeak undertake to frame establish
a body of adjective law first, to be established having the corresponding body of substantive
law too be established afterwards is to undertake bespeak to build
the the house to be first, having the foundations to be laid afterwards:
to undertake bespeak a body of adjective law
to be established first, without any intention of bespeaking
a correspondent body of substantive law to be established afterwards,
is to bespeak a house to be built, beginning at the
roof, and without any intention of giving it its ever having a foundation
on which to stand. Never was the proverbial prefect of
building a castle castles in the air more compleatly verified.

In the instance of the material sort of castle, tje work being all
incapable of being executed in any sort of way whatever, is
never attempted and in their this way no mischief is ever done.
