Whatever has been done not only can be but ought to be done: whatever has not yet
been done either can not be done or ought not to be done, or whether can or ought
to be done

The scraps of adjective law, the incompleat an unmethodized and unconnected regulations of procedure
may have be put into the stock of statute law, may
be furnished expressed with a determinate set of words provided for
the expression of them may in point of practicability; may without inconvenience. For, such are your Acts of Sederunt.
Such are your Rules and Orders, there you see the
precedent, there you see practice.

Substantive law, the rule of action to which men of
all descriptions are called upon to square adjust their conduct throughout
its whole length on the several common occasions of life, this can not be put into the form of statute
law it to any considerable and unbroken extent at least, can
not be furnished provided, or at least ought not to be with any determinate set of words for the
expression of it. Why? because for this here you have no Acts
of Sederunt: for this you have no Rules and Orders.

Whatever has been done not only can be done but ought
to be done: whatever has not yet been done either can not
be done, or ought not to be done, or neither can be
nor ought to be done nor can be done. This under
a system of jurisprudential law, organized by lawyers for the
purpose of giving method and security as well as efficacy
to a system of depredation to be carried on under the mask
of justice, this under a species of law having uncertainty
and incognoscibility for its essence, is the creed of
lawyers.

For wherever pillage is to be consecrated, and by consecration
protected, the religion of lawyers is the religion of
the Chinese: their forefathers are their Gods.
