In the plan of a house, the plan of he foundation being
given, the plan of the superstructure, subject to comparatively
slight diversifications, is also given.
In the plan of a body of law, the Frame body or
substantive part branch being given, the system of pleading,
with less latitude for diversification than in the other cases
is also given: and to those two when given, the remaining
part of the system of procedure though not
so determinately given must be applied and moulded
on fear of not being adapted to its professed purpose.
By the main body substantive portion of the law rule of action (in
civili) titles are created: for the sake of the rights of different kinds to the
establishment of which they are indispensable, obligations of
correspondent kinds imposed: services rendered to the possessors of those rights by the
conferring of those rights, and thence and so far, by the
imperative of those obligations. By the substantive portion
of the law are expressed the different kinds of rights that
a man may have in different cases, the different several various events
or situations in the plan of what they respectively
take place (events collative with regard to rights or of title) and the several events
or situations, with in the taking place of which they are
liable to come (events ablative with regard to title).
