What the particular defendant struck the prosecutor with
quoth the only witness (let this be supposed) was an a regularly for shaped iron bar
of two foot long square at both ends, not sharper at one
place than another: the blow being given, a gash was
, and blood flowed out of it. The account thus
given by the witness of what he says he saw, is it conformable
to the truth? do you believe that that fact took
place which by those words he declared he saw take
place? This is the question of fact. Supposing The prosecutor
being said so dealt with as those words of the witness describe, his
has have been dealt with, was he thereby cut?
this is the question of law.
The words given in this case as expression of the legislator's
are really expression of his will, determinate words
determined and chosen by himself: and supposing them suff
conveyed in the (which by possibility they may have been) to
the notice of them him who, it is proposed shall be put
to death for not conforming to the will declared by them, his conforming
to this will denoted declared by them, was not impossible.
