But the in in being set at £20 it may hap have happened that the pr detriment
to B was over-valued, or that it was undervalued:
and so in the case of the detri estimate by which the detriment
to A was set a £20.
But of the innumerable cases of exemption in
which an exemption from this obligation is granted
by the technical system, there are few, if any, and
those few only by accident or, that are in which
the exemption is placed in any such rational grounds.
Where Of two cases A and B, in case A in which the quantity of evil in the shape of delay
vexation and expence is less they attendant on the
exhibition of the evid article of evidence in question is
half they will the imposition of the obligation will be
refused: in case B in which the quantity of that mass
of evil is greater (the amount of the of misdecision being the same
in both cases, the obligation will be imposed.
Where the obligation is imposed the imposition
of it can not scarce ever be defended but on principles some principle which
passes condemnation in the refusal to impose it
