TURNPIKE ACT. Observations on.
PROCEDURE
60 J 49.56
By the 49th It is provided generally that persons may
act as Justices notwithstanding their being Trustees: This
is to take away the objection to their competency
as Mag Justices from the Interest they may be supposed
to have as Trustees. But by JJ 56, an appeal
is given to offenders convicted whether convicted by Trustees Justices or
Trustees to the Quarter sessions: it certainly was
not meant that a man should " act in the execution"
of the Statute so as to sithear as Justice and the Quarter
Sessions to hear Appeals brought from himself
as Trustee: this therefore should have been guarded
against. This is not the verforum generalitas bene
termenitus recommended by L Bacon [ is not here.]
There is some reason for persons being apprehended itThis expeditious method of apprehension is not intended to the
short hand instance of persons who are guilty of any of the species of
mischief prohibited by SS 31; as they they were however in which there seem
however to be greater occasion for it than here:
Drivers may be supposed to have derive a certain degree of
responsibility from the Service in which they are
settled; & by means of the master's name & abode
are at any time to be not worth:
may be easily found out. Neither of these circumstances
holding good with respect to the offenders
alluded to, unless by great chance they happen
to be known by the persons who discover them
they cannot be convicted.
