To be copied have one or ten persons, or the whole Community
in view: whether the operation of that will be confined
to a day, or a month, or a year: or be extended to any
number of years still it is an expression of the will,
of the Legislator & therefore a Law.
Farther though a benefit granted by the legislature
may be confined to a particular person, yet
that same act contains a declaration of the will of the
Legislature, which is addressed to all the community.
It's directions do, it's penalties may extend to all.
The same Law which gives the field to Titius directs
every member of the Community to abstain
from that field; & denounces penalties agt every
member of the Community who shall interrupt
Titius in the peaceable enjoyment of
the field.
But says our author "a particular act of the Legislature
"to confiscate the goods of Titius & to attaint him
"of high treason does not enter in to the idea of
"a municipal Law." I wish it never did: I wish
there were no proof example of such declarations of the will of the Legislature's thus exerting
its. But our Author's reason if it be true, does proves
nothing: his distinction: his reason is: — "Because the "operation
