To be copied extraordinary exertion of the legislature
can be justified. For if the action for
which Titius is attainted, has already
been declared a crime, then the common
courts of justice are open to inflict punishment:
and there is no occasion to call
in the assistance of the Legislature for
the execution of laws, already in being.
If, on the other hand, the act action was not
declared criminal by the laws, and the
act of attainder, is, to all intents, and
purposes, a new law, made pro re —
natâ (as our author in another place Vol 4. Page 259 declares
