PUNISHMENT It's Measure. A1

Of several attmepts that have been made to ascertain the foundation
(of morality [and the different hypotheses concerning to deduce it's origin] of Clark
Cudworth Hutchinson Wooleston &c. will very well know what I
mean. My design will lead me to consider actions and to determine
their merit only as they are the subject of political regulation.

The difference is great between those principles by which even at this time
of day we judge of the Laws that are made — how much greater is
there between those according to which they were made?

The attainment of the particular end proposed by a Law may be consider'd as
a purchase to be made — the misery introd inflicted by the penalty, as the
price to be paid for it — In this view we may say, the purchase
is always the more or less advantageous, the less the price is that is paid — the
most rigid oeconomy ought ever to be [employ'd adhered to practised] nor ought a great
price ever be paid till it is apparent that the accomplishment
of the end could not be altho purchased at a loss. that universal want
of oeconomy which unhappily is [at present as yet] [every where] universal
may be perhaps be accounted for without much difficulty by considering — that the price
for the most part does not (to continue the Metaphor) come out
of the pocket, of those who settle it — hence in absolute Monarchies
where the Monarch who sets it has is under no apprehensions of paying any part of it. the price is high in almost every Article: and even in our
own Country it is still high [in sometimes even above the value of the
purchase] in those where those they who regulate it are not likely
to be liable — and I believe it is a remark that may be [made with
safety] to every syst that such Articles bear the highest the price of such Articles is the highest [price the which they regu] as is the price of which
least liable to be paid by the regulators. Were had there been any likelihood
