PUNISHMENT. It's End.
With respect to the progress of Society, we may imagine conceive 3 Epochs: distinguishable
in Idea, tho' running into one another imperceptibly indistinguishably in fact: practise — The first, which
is past, in which prevention was very imperfectly accomplished every man actuated by the vindictive principle inflicting an
arbitrary punishment In which Punishment without any settled fixed end [generally recognised] was lodged in the hands of individuals [for a offence] more or less intense according to the
greater or less violence of his passion
The second The 2d after it had been taken out of the hands of individuals and lodged in placed those of the Magistrate tho' still under the same obscurity and uncertainty of the case which is present where prevention is better accomplished in which the Idea of a Public being formed & established
supreme power in the State taking the of vengeance out of the hand of the Individual uses it according to
settled Rules still governed however in great measure by the same principle.
The Third, which is yet to come, in which the Idea all traces of the vindictive principle
being entirely obliterated, Prevention & Prevent shall be the sole end & object of
Legal Legislation. [In which Vengeance shall will be left to that Sovereign who claims it as his own to whom it belongs & to him only.
