The Stat. 19.G.2. 21. as to enforcing the execution,
impotent: Qu. whether by design?
The Reformer's interest is inadequate — It is but The Penalty
the on the Magistrate for not converting is £5- of which The
Informer has half of it, and nothing more
[being a penal Action, he bears his own costs]
No costs are given him — Prosecution must
be within 8 days.
Difficulty of determining what is or what is not
an oath or curse — To enumerate them all
would be as ridiculous as it would be endless
To define give a definition of them might not be easy — No tolerable
one has yet been given.
The objections against the punishment provided
for this offence, or indeed any other punishment
are strong — They might be obviated in great
measure by requiring admonition previous warning to be first given
But before a Justice of the Peace or Clergyman
they warning might be punished without warning
This upon the principle of Recognizances:

is given in foro.
Cursing — why to be punished. Swearing Cursing to be punished 1st as for the sake of
the offender, as an expression of intemperate
passion — 2d For that of a person
offended as a contumely — especially if
a Clergyman or Magistrate.
