It will appear at first sight hard that the innocent owner of the Ox
who is at a distance from the Scene of accident, has no controul over the
Beast to prevent it, and whose volition is no ways concerned in the affair, should
be made to suffer for the negligence of his Son another who himself probably had no criminal
intention — It undoubtedly is hard, and as such is to be lamented. But on
the other hand it is not less so and commonly much more, that the Brother
of the deceased should be deprived of a Brother, the Children of a Parent
or The Wife of a Husband, or perhaps all three, especially where, as it must
frequently happen, it was the deceased upon whose labor the Family depended
principally for it's support — What is therefore to be done; is here is a loss

it shall rest — Now as the Members of the Society State taking pitching upon them at a
are all equally indifferent to the State, it is evident, in the present view of the subject that if on one
hand the loss may as well rest upon the Relations of the deceased as upon
the owner Master of the Driver, on the other it may as well rest upon this latter
as upon the relations of the deceased — Let therefore the loss fall upon
the Master of the Driver: and see what will be the consequence. We may
be assured that from this moment the behaviour of the Driver which further
is not, will become an object of the Master's attention and concern: view
his own loss in his Servant's negligence and cruelty, he will employ the
same care in seeing that that Servant shall be careful as that his Oxen

peculiarly fitted for the purpose, interested to watch in this behalf over the
