Composition should be prohibited under the ordinary penalties; since the sole object
and utility of the regulation proposed is the example — the Execution of the verdict
upon the drover to be performed in Smithfield for the same reason — No
Capias ad satisfaciendum however to be permitted to be said out against the Master —
the efficacy of the example is already attained in good measure by the Verdict: and the execution
is permitted only that it may not be regarded as nugatory: but for that purpose
it is not cannot necessary that in any case the penalty should be strained beyond the limits of his
substance — the insufficiency of his moveables to satisfy the damages and set would
indicate in their undue exorbitance in the Damages. Statutes of Hue & Cry are founded on this same principle as what is have proposed — viz; under that title.
These are the outlines of the regulation proposed — The adjudging adjusting the pecuniary reponsibility
between the Owner of the Cattle and the Master of the Drover, the
anticipating & frustrating projects of evasion that might be formed,
the more particular delineation of the mode of proceeding track of process would demand a more
consideration.
