TURNPIKE ACT 7 G.3.40 — Analysis of — I

1, 2 & 3. (ascertained only by reference)

§ 1, 2 & 3. It estab gives powers to Trustees & Collectors Toll-gatherers
by provisions which to the former are Deliberatable,
to the latter Impromptuary — The persons
with certain exceptions in quos on to whom it establishes enjoins Duties are Owners
& Drivers of Wheel Carriages of Burthen, except
[§ 2] those employ'd only in Husbandry — & except [§ 3] such as are of a particular construction within 100 miles from London also Toll-gatherers in virtue of the 15th Sect It contains
Adjectives provisions + + viz: "Which said additional Toll or Duty, &c of which the persons
per quos a quibus are ascertained only by reference.

The 4th gives Powers to Trustees & is deliberatable

The 5th subjoins limits to certain other of their Powers of
of & is also deliberatable.

The 6th prescribes Duties to the persons mentioned
in the first — to whom it is impromptuary — as also to
Collectors Toll-gatherers both of itself & in virtue besides of the 15th to whom also it is impromptuary: &
gives powers to Trustees to whom it is deliberatable

The 7th also prescribes Duties to the such of the persons mentioned in
the 1st as shall pass along any Turnpike above
Gatekeepers Surveyors 20 miles from London: also to Collectors Toll-gatherers & also

to Turnpike Surveyors within the same limits both of itself & in virtue of the 15th to all of whom it is
impromptuary

The 8, 9 & 10, 11, 12, 13, & 14 prescribes & qualify Duties
to Owners & Drivers the persons mentioned in the 1st as also to
Toll-gatherers in virtue of the 15th

The 11th & 12 establish cases of dispensation from those
duties — They also give powers to Trustees & to
Justices in Quarter Sessions to both of whom they
are deliberatable — and the 11th prescribe a duty to the Clerk of
the Peace to whom there it is deliberatable.

The 13th & 14th prescribe duties to persons mentioned in
the first; as also to Toll-gatherers in virtue of the 15th

The 16th prescribe Duties composes penalties for non-compliance with
preceding duties regulations on Drivers only of the carriages
in question — It gives powers to all persons in
general as persons & Constables by name per quos a quibus others to single Justices as persons
per quos, to all of whom it is impromptuary: It establishes
Adjective provisions.

The 17th & 18 prescribe Duties to Owners only of the Carriages
in question: to whom they are impromptuary. + + Qu- whether this & all other regulations respecting the construction of Carriages are not rather Deliberatable?

The 19 & 20th 21st & 22 confer & limit powers prescribe duties to Trustees: to whom & and prescribe
they are impromptuary. deliberatable Duties & limit powers to Owners:
They are deliberatable to both They require no notification except in the view to induce Carriers to provide themselves with carriages of the construction therein favored: for the rates of Toll are notified on the spot

The 22d limits the powers of Trustees & of Owners
of Carriages: in question to both of whom it is deliberatable
The 19, 20 & 21 confer give & limit powers to Trustees: &
is deliberatable

The 22d limits the powers of Trustees & of Owners
of the Carriages, in question & is to both deliberatable.

The 23 concerns in every way persons of every description by
establishing exceptions concomitant to every clause
in the Act.

The 24 concerns prescribes duties to Owners &
Drivers (tho' not nominibus) of Car of the Carriages
in question: it is impromptuary.

are deliberatable

to whom it is in in pairs & prescribes duties
to Surveyors — tho' It is deliberatable to both

The 28th prescribes duties to Surveyors & [perhaps
also to Toll-gatherers] & gives Powers to single
Justices to the 1st it is impromptuary, to the latter
deliberatable.

Land-Occupiers The 29th restrains powers of + + Qu. also whether some others which I have mentioned as prescribing Duties might not better be mentioned as restraining powers Husband-men in general of occupiers of Land
adjoining to whom it is impromptuary. It contains Adjective Provisions.
It gives powers to single Justices to whom it is deliverable.

The 30th gives powers to Trustees & prescribes
Duties to Surveyors — It is impromptuary deliberatable to
both.

22.

A General § All persons The 31. restrains powers of all persons in
general — to whom it is impromptuary It gives powers to single Justices
to whom it is also deliberatable in one aspect but impromptuary in another.

23.

The 32 restrains powers of all persons under
the pain of Death — whom it is impromptuary
It contains Adjective provisions.
