Of these two divisions or modes of division, the
principal is that which has for its source the difference
between the two functions of government
Legislation, as abovementioned is the function
which in the composition of the present work was
principally and almost exclusively in view. To
extend the investigation to such fallacies, if any, the
occasion d demand for which, so to speak, is confined
or more properly
the temptation to the
use of which
exclusively to judicial discussion to the discourses of
which have the judicatory for their theatre must
be left to another time, which is as much as to
say to another hand. Of the fallacies here brought to
view, together with such others as [it may happen]
to subsequent investigation [to] may bring to view, scarcely it is
believed can any be found the demand
for which may not occasionally be presented by those
discussions description debates of which the judicatory is the scene receptacle. But
in addition to these, others it is believed might
naturally be found for which the demand would much
more frequently present itself in the course of
the operations performed in that field than in the course
of those which are customarily performed in the field
of legislation.
