existing law would
in a future generation be
likely (it is supposed) to
appear pernicious:
the more likely the
more probable it should
then be abrogated:
the greater therefore, in
the view of those who
are determined if
possible to prevent it
from being abrogated,
the need of this and
whatever other measures
present a chance of
being productive of
that effect.

The only innoxious
application of an
oath to this subject
would be made by
an oath promising
never to impose any
other such oath:
here whatsoever were
the absurdity there
would be no mischief
Though the absurdity would remain unaltered, one case
in a and the only case in which the imposition of an
oath of this sort would not be mischievous, is that which
would have place if the act line of conduct thus undertaken for
consisted in the never taking of any such oath on
any other occasion or to any other purpose.
Suppose the purpose of the oath the promise engagement of the oath to be to this effect,
viz. an engagement never to take any such
oath on any other occasion or to any other purpose.
The absurdity — the original and indelible absurdity
would still cleave to it: but as to mischief, instead
of being mischievous — it would be positively beneficial: beneficial
to the amount of all the mischief which it might
have the effect of preventing — all the mischief which by
all the absurd and mischievous engagements of this
sort put together — that otherwise might have been
entered into might would have been produced.
