Ch. 2. Jephthah's
§.4. Coronation Oath
3
24 or 3 continued
The provision thus made is slovenly enough, [and but not the
less well adapted to the purpose for which it by the person whose particular interests were to be served by it appears to have
been designed.] (Quere?) Already in existence and provided
by Act of Parliament was an Oath to much the same
effect viz. the Coronation Oath an clause abovementioned
with a clause, viz. the clause above quoted to much the
same effect. The oath here stipulated for was it meant
to be of exactly the same tenor as that already established
Oath? — then why not adopt it by express reference?
Was that not looked upon as sufficient? was it intended
that any addition or variation should be made to it?
then why not exhibit that in terminus such intended addition or
variation, or what would have been much better, and
in the spirit of that Act itself as declared by the preamble
substitute an entirely new one?
In the reign of William and Mary, of the Oath then
thought fit to be ordained prescribed, the very tenor was prescribed
in and by the Act. In this Act of Anne why
was not this same principle of correctness why was
it not pursued? In the power of what individual
or body of individuals is the power of determining
the words and by means of the words the import and
effect of so important an instrument to be understood to
be lodged?
By this omission an expectation was suggested
of finding it supplied by some succeeding Act: but upon
search no such Act could be found.
