The public functionary, knowing himself to be such
and knowing that in the Code there was a mass of
law speable bearing special relation to Public functionaries, would thereby from thence receive notice have sufficient advertisement
to store his mind with whatever unarmed been in that
mass of law and thereby with the clause by which in
case of the delinquency in question in his part be would stand
subjected to the punishment attached to it. But without taking
the matter upon the falling or which it no such notice would be have. stands, he would have
no such notice Offences against the liberty of the nation
as the head under which the appointment made of these
eventual punishments so placed. To the public functionary
as such what is the notice does that can be increased by a title so general and
so and souncharacteristic a title?

Now in passant that for every particularclass of public
functionaries (not to speak of other occupation and conditions
in life) having legislative arrangements peculiar to itself,
my sake plan given a separate Code, which upon the
entrance of each individual into his situation is required to should be put
into his hand. In this h Code the first title will would
be headed Public functionaries in general their powers,
rights and duties: thence proceeding their thus so many
titles headed with for the several the several denominations of the several
decisions are within another to which he belonged, concluding
with the class denomination of that least extensive
class to which whole he himself belonged but no one of the individuals
comprehended in any of the division beforementioned div belonged
i would no more punish think of punishing a mere bel functionary is not
functionary for non-observance of a law that had never been
put into his hands, than I would know think of punishing a child knowing of a serv
for not which had for not having
performed a lesson that had never been set him.
