Hitherto the great difficulty has been supposed to
be be in the ensuring employment to such as would be willing
to accept it: but some of them may make no such
option
Note
The security thus afforded for their good behaviour it
must be confessed is not so entire as that afforded by
the present colonisation plan of transportation which under the name of
transportation for various terms is in effect transportation for
life. Neither can it be made so without a fresh law to compel
them such of them continue them notwithstanding them
each prisoner on pain of continuing in the Penitentiary establishment, to
make his option between the army service the navy service
or an engagement from year to year in the subsidiary
establishment, unless he can find a responsible person to
stand security in a moderate sum from year to year for his maintenance &
good behaviour. from year to year Such obligation, if
inflicted by law may seem an arbitrary a hard and unjust extension
of the original sentence: but the utmost of such hardship and
injustice is nothing trifling in comparison of that which they undergo
at present by a perversion of the law. It is upon this very perversion that all But the advantage

plan actually depends: upon
