Sect. II Contract.

Panopticon Bill.

Sexes to be kept separate —

Art. 5. If, in virtue of any such Contract, Prisoners of both sexes shall be intrusted
to the Governor's care, provision shall be made that the two sexes shall either not be kept under the
same roof, or that at any rate they shall be kept in different divisions, and that in such manner
that, between division & division, no forbidden intercourse shall at any time be practicable.

Governor may employ Prisoners
for his own benefit —

Art. 6. In such Contract may be a clause authorizing the Governor to employ
the Prisoners for his own benefit: for which purpose he shall have the same powers over them as
any Master has over any species of Servant by Common Law.

Duplicate of Contract to be lodged
in the Crown Office —

Art. 7. On the signing of every such Contract, a duplicate thereof shall also be
signed and shall be forthwith transmitted by the Governor to the Clerk of the Crown in the
Court of King's Bench, and shall be by him kept among the Records of his Office.

Persons committable on
the footing of Penitentiary Prisoners —

Art. 8. Persons who may be committed to the said Prison in quality of Penitentiary Prisoners are the following.
1. Any person who in virtue of any Statute present or future either now is, or shall or might have been under Sentence of Transportation.
2. Any person who in like manner either now is, or hereafter might have been, under Sentence
of hard labour on board any Hulk lying or to lie in the River Thames or elsewhere.
3. Any person having accepted his Majesty's most gracious pardon on condition of
Transportation, provided such Offender chooses so to be committed instead of being transported.
4. Any person who for any felony is under Sentence of imprisonment in Newgate or any other Prison.
