4 Contract Panopticon Bill

Governor a Corporation Sole —

Art. 4. The Governor for the time being shall be a Corporation Sole: and as such
capable of purchasing Heriditaments in succession: and of suing and being sued by that
description and not by name.

Sexes to be kept separate —

Art. 5. If in virtue of any such Contract Prisoners of both sexes shall be intrusted to
the Governor's care, provision shall be made that the two sexes shall either not by kept under
the same roof, or that at any rate they shall be kept in different divisions, and that in such
manner that between division and division, no forbidden intercourse shall at any time be
practicable.

Governor may employ Prisoners
for his own benefit —

Art. 6. In such Contract may be a clause authorizing the Governor to employ the
Prisoners for his own benefit: for which purpose he shall have the same powers over them as any
Master has over any species of Servant by Common Law.

Duplicate of Contract to be lodged
in the Crown Office —

Art. 7. On the signing of every such Contract, a duplicate thereof shall also be signed
and shall be forthwith transmitted by the Governor to the Clerk of the Crown in the Court of
Kings Bench, and shall be by him kept among the Records of his Office.

Persons committable on the footing
of Penitentiary Prisoners —

Art. 8. Persons who may be committed to the said Prison in quality of Penitentiary
Prisoners are the following,
1. Any Person who in virtue of any Statute present or future either now is, or shall or might
have been under Sentence of Transportation.
2. Any Person who in like manner either now is, or hereafter might have been, under Sentence of hard
labour on board any Hulk lying or to lie in the River Thames or elsewhere.
3. Any Person having accepted of his Majesty's most gracious pardon on condition of Transportation,
provided such Offender chooses so to be committed instead of being transported, & not otherwise.
4. Any Person who for any felony is under Sentence of imprisonment in Newgate or any other
Prison.

Sect. III. intitled Purchase of Land.

1.
Powers of Entry, on payment of
the original purchase-money, and
publication of notice on the
premises —

Art. 1. Such Contract as abovementioned being duly signed, duplicate thereof filed as
abovementioned, and the said sum of £6600 duly paid as herein after mentioned with reservation of such
eventual addition as is also herein after mentioned, the said Jeremy Bentham, or any person duly
nominated by his Majesty and appointed Governor of the said intended Penitentiary House, may in
person or by any Agent at any time within two years from the passing of this Act make entry
upon the premises, thereby taking seisin and possession as against the Owners of the same which
said Entry may be performed according to the Form marked [B. 1.] hereunto subjoined:
immediately upon which entry so made, the said Jeremy Bentham or such his Successor shall
be deemed not only to have Seisin thereof in Fee Simple, but also be be in actual possession
thereof, as against the Owner or Owners of the same, in the same manner as if such Seisin &
Possession had been respectively delivered to him in pursuance of His Majesty's Writs of
Habere facias Seisinam and Habere facias Possessionem.
