Compensation for sudden dispossession

Art.14. And Whereas justice requires that adequate compensation be made ot the
actual Occupiers for all such damage as may accrue, not only from the accelerated cessation of that respective
interests but from the sudden obligation of removing their stock form any part of the premises
of which for the purposes of this Act it may have been deemed necessary to make immediate
use. Be it enacted that if within one month after Entry made into any such parcel such
compensation as aforesaid be not made, the same shall be assessed by a Jury to be impanelled at
the costs of the said intended Purchaser in manner as abovementioned; provided that, within
three months after the expiration of the said one month, application be made as aforesaid by
any party interested: to the amount of which compensation money, when found, shall be added interest
at the rate of 5 per cent from the day of entry to the day when the principal of such compensation
money shall have been paid: and if within one Calendar month after the finding of such
Verdict, payment of such principal and interest be not made, execution may be awarded by any Judge
as aforesaid in the like manner as upon judgment given in an Action on the case

Measure of damages in such
case

Art.15. In the assessment of such compensation, the damage shall be, in
the case of a lease for years, if any such there be, the Value of such Lease: in the case of a tenancy at
Will, the damage sustained by the loss of the portion of time included between the day of Entry made
as aforesaid, and the day on which, in the case of warning given, an Action of Ejectment might be
commenced in the ordinary sense of Law: deducting in both cases the Value of the Rent of which
the Occupant will by such Entry have been exonerated.
