and if, within one Calendar Month after the finding of such Verdict, payment for such
principal and interest be not made, execution may be awarded by any Judge as
aforesaid in like manner as upon Judgment given in an Action on the case.

Measure of damages
in such case. p. 9.

Art. 15. In the assessment of such compensation, the damage considered
shall be in the case of a Lease for ears, if any such there be, the value of such Lease in
the case of a tenancy at Will, the damage sustained by the loss of the portion of time
included between the day of entry made as aforesaid, and the day on which, in the case
of warning given, an action of Ejectment might be commenced in the ordinary
course of Law: deducting in both cases the value of the rent of which the occupant
will by such entry have been exonerated.

Powers to make a Cut cut a Canal

Art. 16. And whereas for the more commodious conveyance of bulky
commodities to and from the said formerly intended Penitentiary Houses, a Cut canal was
intended to be made cut from the rising ground being the immediate site proposed for the same
to the River Thames, and whereas the expence of making such Cut cutting such canal was accordingly
included in the Estimate so approved as aforesaid, And whereas in order to effect such
communication it would be necessary that the present Watercourse crossing the
Road from Battersea to Wandsworth & running under the Bridge called
York Bridge should be deepened & enlarged, the same being incapable of admitting
any Barge or ordinary Boat, Be it enacted that for the purpose of effecting such
communication the said intended Purchaser or his Representatives, owners of
the said Panopticon-Hill Estate, may at any time at their own expence widen and
deepen as well the said Watercourse as the Channel of the Creek running therefrom
into the said River, to wit in such manner as to enable such Cut canal to
receive any such craft as are or can be used on the said River from Battersea Bridge
upwards, and for that purpose to pull down and rebuild the said York Bridge.

Art. 167. Provided always that the obligation of keeping in repair the
said Bridge when rebuilt as aforesaid shall lie forever as a charge upon

Art. 18. Provided also that no unnecessary Damage be done to the
adjacent Lands, and that for such unavoidable damage, if any, as may be
necessary to the making of the said cut, due satisfaction be made to the owners and
occupiers, according to their respective interests; to wit by agreement or in default
thereof, according to the valuation of a Jury, to be impanelled in like manner
and on like conditions as abovementioned.
